the rules of the road for using point luna.

agreement

by accessing or using point luna — the website, our datasets, our tools — you agree to these terms and to our privacy policy, which is incorporated by reference. if you don’t agree, please don’t use the service. point luna is operated by its co-founders, leah holden and shyam sunder sriram; references to “we,” “us,” or “point luna” mean those operators.

what point luna is

point luna is a curated, public-data warehouse and a set of tools we're building on top of it. it's currently in early access. features may change, break, or disappear without notice. we don't currently charge for access and we don't sell anything through the service.

eligibility

you must be at least 18 years old, or the age of majority in your jurisdiction (whichever is older), and have the legal capacity to enter into this agreement, to use point luna. you must also use the service in compliance with all applicable laws.

point luna is not directed to children under 13, we don’t knowingly collect information from anyone under 13, and we’ll delete any such information if we learn we’ve received it (see the privacy policy).

access

access to the point luna data warehouse is granted by adding the google account email you provide on the signup form to the iam policy of our bigquery dataset (pointluna-data). we issue access at our discretion. don't share the credentials of the google account that's been granted access. we may revoke access at any time, including if it's being abused or if you breach these terms.

acceptable use

point luna’s datasets come from public sources. you can:

  • query them through your own google cloud project
  • download and use the data for research, journalism, policy, internal analysis, or commercial work
  • share findings, cite point luna, and build on top of our schema

prohibited use

you shall not:

  • submit personally identifying information about yourself or other individuals in queries — no addresses, health information, names, nothing like that. point luna queries should be about datasets sourced from public data and geographies, not about specific people.
  • bulk-extract or systematically mirror our datasets, schemas, or metadata to redistribute them, host a competing data warehouse or mcp, or otherwise substitute for point luna. you remain permitted to use any individual dataset for research, journalism, policy, or commercial analysis subject to that dataset’s source license — what we don’t allow is repackaging our curation work itself into a competing offering.
  • attempt to circumvent rate limits, scrape the site, or otherwise disrupt the service
  • use point luna to violate any law or another person’s rights
  • misrepresent who you are or your affiliation
  • probe for security vulnerabilities without first contacting us for responsible disclosure at team@pointluna.ai

feedback

if you send us comments, suggestions, ideas, or other feedback about point luna — by email, in conversation, or any other way — you grant us a perpetual, worldwide, irrevocable, royalty-free license to use that feedback for any purpose, including improving the service, without any obligation to you. we won't be required to keep your feedback confidential and we may freely use anything similar we already had or develop independently.

point luna content and data

the underlying datasets are public and remain governed by their original licenses; check the source for each dataset before relying on it. our documentation and schemas are yours to use freely (subject to the prohibited-use section above); attribution is appreciated but not required. our code, brand, and logo are not licensed for use without our written permission.

privacy

our handling of your information is described in the privacy policy. by using point luna, you acknowledge that you’ve read it.

availability and changes

point luna is in early access. we don't guarantee uptime, accuracy, or continued availability of any feature. we may modify, suspend, or shut down the service — in part or in whole — at any time, with or without notice and without liability to you. we may also refuse, restrict, or revoke your access for any reason, including violation of these terms, abuse of the service, or to protect the safety or integrity of the service.

force majeure

we won't be liable for any delay or failure to perform under these terms caused by circumstances beyond our reasonable control — including outages or failures of our hosting providers, internet service providers, or other upstream infrastructure; acts of god; natural disasters; pandemics; war; terrorism; civil unrest; labor disputes; or government action.

copyright complaints

if you believe that material on point luna infringes your copyright, email team@pointluna.ai with the subject “copyright complaint” and include: (a) a description of the copyrighted work you say has been infringed, (b) the url or other location on point luna where the allegedly infringing material sits, (c) your name, address, phone number, and email, (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law, (e) a statement made under penalty of perjury that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf, and (f) your physical or electronic signature. we’ll respond to valid notices in accordance with the digital millennium copyright act.

disclaimers

point luna is provided “as is” and “as available.” to the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. data accuracy depends on the underlying public sources — verify before relying on point luna for any important decision.

limitation of liability

to the fullest extent permitted by law, Point Luna and its officers, directors, employees, agents, affiliates, successors, and assigns are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the service. our total aggregate liability for any direct damages is limited to the greater of (a) one hundred us dollars ($100) or (b) the amount you have paid us in the twelve months preceding the claim. some jurisdictions don't allow some of these exclusions, in which case they apply only to the extent permitted there.

indemnification

you agree to indemnify and hold harmless Point Luna and its officers, directors, employees, agents, affiliates, successors, and assigns from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the service, your violation of these terms, or your violation of any law or third-party rights.

informal dispute resolution

before filing any formal claim, you agree to first email us at team@pointluna.ai with a description of the dispute, what relief you’re asking for, and your contact information, and to negotiate in good faith for at least 30 days. most disputes can be resolved this way, and we’d like the chance to try.

governing law

these terms are governed by the laws of the commonwealth of massachusetts, usa, without regard to its conflict-of-laws rules. you and we agree that any disputes arising from these terms or your use of point luna will be brought exclusively in the state or federal courts located in massachusetts, and each of us consents to the personal jurisdiction of those courts. nothing in this section limits any non-waivable rights you may have under the law of your home jurisdiction — including, for california residents, rights under the ccpa and cpra as described in our privacy policy.

changes to these terms

we may update these terms from time to time. when we do, we'll post the new version with an updated date below. for material changes affecting users, we'll also send a notice to the email address tied to your access signup form submission. continued use of the service after that date counts as acceptance of the new terms.

electronic notices

you agree that we can send you legal notices and other communications about point luna electronically — by email to the address tied to your access signup form submission, or by posting them on the site — and that those electronic notices satisfy any legal requirement that the notice be in writing.

assignment

you may not assign or transfer these terms, by operation of law or otherwise, without our prior written consent — any attempted assignment without consent is void. we may assign or transfer these terms (and our rights and obligations under them) without your consent, including in connection with a merger, acquisition, sale of assets, or other corporate transaction. these terms bind and benefit each party's permitted successors and assigns.

no waiver

if we don't enforce a provision of these terms on a given occasion, that's not a waiver of our right to enforce it later. no waiver is effective unless we put it in writing.

severability

if any provision of these terms is found unlawful, void, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if that's not possible, removed — and the rest of these terms will remain in full force and effect.

entire agreement

these terms, together with the privacy policy, are the entire agreement between you and point luna concerning the service and replace any prior discussions or agreements on the same subject.

no agency or third-party beneficiaries

nothing in these terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and point luna. these terms are solely between you and us, and no third party has any right to enforce any provision of them.

survival

the sections of these terms that by their nature should survive termination — including the disclaimers, limitation of liability, indemnification, governing law, informal dispute resolution, and these general provisions — will survive any termination of your access to point luna and continue to apply.
